BREAKING NEWS: GA DOI Publishes Model Notice as Required by SB94
On June 4, 2009, GA DOI published a Model Georgia State Continuation Coverage Election Notice as required by SB 94. Once read, its purpose and meaning should be evident, but there are some issues that warrant summary here:
- An assistance eligible individual (AEI) who had a qualifying event between September 1, 2008 and February 17, 2009 can elect a period of coverage that begins as late as 60 days from the date of their notice of eligibility under SB 94 and ARRA.
- Such coverage may last as long as it would have had the AEI been eligible for COBRA and had elected such coverage as would have been required after the qualifying event, but in no case will such period of coverage last more than nine months.
- An AEI can elect, if available, coverage under a HDHP without fear they will be ineligible for premium reduction.
- Language that changes treatment of claims experience for "covered individuals" under state continuation apply whether or not such individual is an AEI. This and the option to elect HDHP coverage are the only features of SB 94 that make a permanent change in state continuation law that survive beyond ARRA and its effect of law.
